Deng Weizhi, Gou Jianli and Zhang Chengfen, deputies to the Chinese People’s Political Consultative Conference (CPPCC) put forward No. 4072 Proposal at the CPPCC and Chinese People Congress (CPC) held in March of 2004, after participating a symposium in the Maple Women’s Psychological Counseling Center. The proposal entitled “Draft suggesting the elimination of domestic violence” was worked out based on a discussion with the Maple Center. It suggests that more regulations should be added to the Marriage Law revised in 2001. The draft regulations are as follows:
1. Exact definitions should be given to domestic violence. It refers to the harm of the body, mind, sex and property among family members, including:
(1) Infringement and restriction of the body;
(2) Sexual abuse, harassment, depreciation and other sexual behavior that wound a person’s body, sense of independence and self-esteem;
(3) Conductions that insult, slander and seriously infringe a person’s reputation, private matters and dignity of human personality;
(4) Conductions that damage, deprive off, reduce and hinder a person’s property or the way of earning economic resources;
(5) Illegal conductions of fetus sexual identification and forced abortion;
(6) Other conductions that resulted in the harms of the body, mind, sex and property of the family members.
2. The State and governments at various levels should adopt prevention measures to prevent domestic violence from happening. Suggestion:
(1) Working out relative laws, legal regulations and policies and setting up a relative system;
(2) Establishing a particular organ to prevent and eliminate domestic violence and to protect the abused;
(3) Setting up and carrying out a fence reporting system for domestic violence;
(4) Conducting researches on domestic violence, setting up data system, carrying out public education in order to raise public awareness and thus preventing domestic violence from happening;
(5) Supporting mass organizations, social groups and NGOs involving in the prevention and elimination of domestic violence.
3. It is the common responsibility of the entire society to prevent and eliminate domestic violence. The neighborhood (village) committees, enterprises, institutions and social groups are expected to shoulder the duty of preventing and eliminating domestic violence. Active work of social aid should be carried out.
